Terms of Service

These terms are an agreement between you and Calypso, who runs sunken.ink at https://sunken.ink.

You accept them when you create an account. That is the moment this becomes an agreement between us, and the Rules are part of it. If you are only reading the site, the parts that can apply to you are the ones about what the site is, what we do and do not promise, and how far our liability goes.

The Privacy Policy is not part of this agreement and is not something you sign up to. It is our explanation of what we do with your personal data and what you can make us do about it, which the law requires us to give you whether you agree with it or not. Read the two together.

If you do not agree to these terms, do not create an account.

You must be at least 13 years old to create an account.

If you are under 18, you should have your parent or guardian read these terms with you. A young person's ability to enter an agreement like this is limited under Norwegian law, so if a parent or guardian tells us they do not agree to it, write to us and we will close the account.

You may not use the site if a previous account of yours was permanently banned, unless we have agreed in writing that you may return.

You are responsible for what happens under your account. Choose a password you do not use anywhere else, and do not share it.

Tell us at [email protected] if you think someone else has got into your account. Changing your password from the settings page signs out every other session immediately.

You may close your account at any time by writing to [email protected]. What happens to your data when you do is set out in the Privacy Policy.

Usernames cannot be changed by members. Ask staff if you need one changed and we will look at it.

You keep ownership of everything you post. We do not claim it, we do not sell it, and we will not use it to train anything.

By posting, you give Calypso a non exclusive, worldwide, royalty free licence to store, display, reproduce and distribute that content on sunken.ink, and to show extracts of it elsewhere for the limited purpose of describing or promoting the site. This licence exists so that the software can legally put your post on a page for other people to read. It lasts while the content is on the site, and it ends when the content is removed, except where another member has quoted you, in which case the quotation may remain.

You promise that what you post is yours to post, and that it does not infringe anyone else's rights.

You may edit or delete any of your own posts, except the first post of a thread. Deleting that one would take the whole thread with it, including replies other people wrote, so only staff can do it and they will weigh what else is in the thread first.

If you ask us to delete your account and to delete your posts with it, that does remove threads you started, replies from other people included. The Privacy Policy sets out the choice you get and what each option does.

Golden Eggs are points the site gives you for taking part: when someone inks a post of yours, when you post, on your first visit of the day, and when you earn a badge. You spend them at the exchange on things for your name, your avatar and your card, or send them to another member.

They are not money and never become money. They have no cash value, cannot be bought for money, and cannot be sold, traded or exchanged outside sunken.ink. Gifting eggs to another member inside the site is allowed. Selling them to anyone, for anything, is not.

What you buy is a look, not a right. A title, a name effect, a frame, a border or a badge slot is a cosmetic on your account and stays subject to these Terms and the Rules. If we retire something you bought, we put the eggs back. If a title you set breaks the Rules, staff remove it and the eggs are not returned.

We can adjust them. Eggs earned by breaking the Rules, such as trading inks, farming posts, or using a second account to ink yourself, can be removed, along with anything bought with them. Every change to your balance is written to a ledger you can read on the exchange page, and a staff adjustment says so there.

Eggs belong to the account. They go when the account does, and they cannot be moved to another account by us on request.

The Rules set out what you may and may not post. They are binding, and breaking them is breaking these terms.

Separately from the Rules, you agree not to:

• Access accounts, data or parts of the site that you are not meant to reach.
• Probe, scan or test the site's security without our written permission, or interfere with its normal operation.
• Scrape the site automatically, or use bots to post, vote or register.
• Circumvent rate limits, cooldowns, bans or any other restriction.
• Use the site to send unsolicited messages or to distribute malware.

We may remove or edit any content, and suspend or close any account, where we reasonably believe the Rules or these terms have been broken, or where we are required to by law.

Some restrictions are applied automatically, without a person looking first. The site measures how members vote on each other's posts, and it detects when one person is running more than one account by the browser they use. Either can restrict an account on its own. When that happens:

• Everything the account writes is held for a staff member before anyone else can see it.
• Most of the forum closes to it. Two boards stay open, Feedback and Bugs and Stained Appeals, along with any thread it started itself, so it can always say something and always ask for the restriction to be lifted.
• Its profile is closed to other members and shows only its name and the reason, and it cannot open other members' profiles either.
• Where the cause is a second account, you are named in public, twice. The other account's name is shown on the restricted profile, and an automated account called Catfish opens a thread on a public board naming both accounts and listing every one it has found. Being publicly identified as running more than one account is a consequence of doing it, and it is meant to be.
• If we later decide the detection was wrong, we clear the mark and the Catfish thread is taken down with it.
• The internet addresses the account was used from are recorded. A new account from one of those addresses is not restricted for that reason alone, because a household or a school is one address and the other people on it have done nothing. It is only flagged for a staff member to look at, and it is restricted only if the browser matches as well.

The full list of what triggers this and exactly what it does is in the Rules, which are part of these terms. Nothing is deleted, a person can lift it, and there is an appeal board for exactly this.

Some breaches leave a permanent, public mark on the account rather than, or as well as, a restriction: a badge worn on the profile and on every post, put on by an administrator for the rule broken, or by the software where the cause was a second account. It does not expire, it cannot be taken off by the member, and only an administrator removes it. The Rules list the marks, what each means and how to appeal one.

We will normally tell you what we did and why. Where the content is illegal, or where telling you would put someone at risk, we may act first and explain later, or not at all.

You can appeal, and the process for that is in the Rules.

sunken.ink is a non commercial fan project. Splatoon and all of its characters, artwork, music and other content are the property of Nintendo. This site is not affiliated with, endorsed by, sponsored by or approved by Nintendo.

Character artwork shown on this site is sourced from Inkipedia and remains the property of Nintendo. It is used here to illustrate an archive about the games.

The lore articles, the design of the site, and the code behind it are our own work, except where stated.

If you believe something on this site infringes your copyright, write to [email protected] with:

1. Enough detail to identify the work you say has been infringed.
2. A link to the post or page where it appears.
3. Your contact details.
4. A statement that you believe in good faith that the use is not authorised by you, your agent or the law.
5. A statement that the information you have given is accurate, and that you are the rights holder or authorised to act for them.

We will look at every complaint. Where a complaint is clear, we will remove the content and tell the member who posted it. They may reply to us disputing it, and if their reply is convincing we may restore the content and tell you.

Repeatedly posting material that infringes other people's copyright will get an account closed.

This is a hobby project run by people in their own time. It is not a paid service and there is no uptime guarantee.

We may change, suspend or stop any part of the site at any time. If we decide to shut the site down entirely, we will give at least thirty days notice on the site where we can, and we will provide a way for you to take a copy of what you have written.

We may also change these terms. When we make a change that materially affects you, we will post about it and update the date on this page at least fourteen days before it takes effect, unless the change is required sooner by law. If you keep using the site after a change takes effect, you accept it.

The site is provided as it is. We do not promise that it will always be available, that it will be free of faults, or that anything posted here is accurate.

The lore articles are written by fans reading published material. They are not official, and where something is uncertain we try to say so. Do not rely on them for anything that matters.

Content posted by members is theirs, not ours. We do not check every post before it appears, and a post staying up does not mean we agree with it.

To the extent the law allows, Calypso is not liable for indirect or consequential loss, for lost data, for lost profits, or for anything arising from content posted by other members.

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, for gross negligence, or for anything else that cannot be limited or excluded under Norwegian law. If you are a consumer, your rights under mandatory Norwegian consumer law are not affected by anything written here.

Because this is a free service, our total liability to you for any claim is limited to the greater of the amount you have paid us, which is nothing, and 1000 Norwegian kroner.

You can end it at any time by closing your account and not using the site.

We can end it by closing your account, in the circumstances set out above and in the Rules.

Ending the agreement does not undo anything that already happened. The sections on your content licence, copyright complaints, liability and governing law survive it.

Norwegian law governs this agreement.

If we cannot sort a dispute out between us, it goes to the Norwegian courts, with Oslo District Court as the agreed venue. If you are a consumer resident in another country in the European Economic Area, this does not take away your right to bring a claim in the courts of the country you live in, or to rely on the consumer protections of that country.
